An attorney representing the man accused of fatally shooting a 20-year-old Waianae man at the Ala Moana Center parking lot early Sunday said Kapono J. Miranda, 23, was “viciously attacked” by another male just before the shooting.

Miranda made his initial court appearance before Judge Melanie May with his attorney, Victor Bakke, at Honolulu District Court Wednesday on a second- degree murder charge in the death of Alan C. Jennings. He was also charged with two firearm offenses.

After the hearing ended, Bakke said Miranda underwent surgery for a broken jaw he sustained when a male — not Jennings — “false cracked” him just before the shooting.

Miranda is being held at the Oahu Community Correctional Center in lieu of $1 million bail. Bakke said he intends to seek a bail reduction.

The shooting occurred shortly after 1 a.m. Sunday in the parking lot fronting Lucky Strike Social Honolulu.

A witness turned over to police footage of the shooting she recorded with her phone that showed a man, later identified as Miranda, pointing a gun at Jennings, who had his hands in the air, according to a police affidavit. The video showed Miranda firing one shot, after which Jennings slouched over, police said.

The police affidavit indicated Jennings and his friends were outside of Lucky Strike waiting for another friend when Miranda and two males walked out of the establishment.

Jennings’ friends alleged Miranda gave them “stink eye” and acted aggressively toward them.

Police said Jennings and Miranda exchanged words before Jennings’ friend intervened and punched Miranda in the mouth.

Miranda then pulled a semi-automatic gun from his waistband and fired at least two shots and fled, police added.

Jennings was taken in critical condition to The Queen’s Medical Center where he died of a single gunshot wound to the chest.

Police detained Miranda in the parking lot of the First Hawaiian Bank on Kapiolani Boulevard and arrested him on suspicion of murder.

A 9-mm semiautomatic gun was recovered from the bed of a Toyota Tacoma pickup truck at the scene of the shooting.
