Cindy Nguyen pointed to Toby Stangel in state court Monday as the person who fatally shot her mother at a stoplight in Kaimuki nearly two years ago.

"I saw someone come out of the car, and he kind of walked over, not to our car, but outside of his car. And he lifted one hand and started shooting," Nguyen said.

Stangel, 30, is accused of killing Tammy Nguyen, 54, injuring two other motorists and shooting at four others, including two police officers, during a 17-minute crime spree on Wai­alae Avenue and the H-1 freeway on June 3, 2011. He is on trial for second-degree murder, first- and second-degree attempted murder, firearms charges and drug and drug paraphernalia possession.

At about 12:30 a.m. that day, Tammy Nguyen and Cindy, the youngest of her 10 children, were heading home to Palolo from Ward Theatres, where Cindy, then 16, had just finished work.

Nguyen was driving the family van. Cindy was in the front passenger seat.

Cindy Nguyen said she heard earlier gunshots but thought they were the sounds of heavy crates falling at Foodland Super Market nearby.

Deputy Prosecutor Dwight Nada­moto told the jurors in opening statements Monday that the earlier sounds were of Stangel shooting at another motorist, Michael Pag­di­lao, at the same traffic light.

Pagdilao testified it was Stangel who shot at him.

When Stangel started shooting at the van, Nguyen said she ducked and didn’t raise her head until she heard what she believed was the screeching tires of Stangel’s car leaving the scene. The van was slowly moving forward, so Nguyen said she turned the steering wheel to the right until the van hit a light pole and stopped.

She said she heard the sound of something dripping and thought it was because of damage to the van. She said she soon realized it was her mother’s blood.

Nguyen said she called 911 and put pressure on her mother’s neck to slow the bleeding. She said her mother was unconscious and was having difficulty breathing.

The ambulance arrived, and Nguyen rode with her mother to the hospital, where she died, never having regained consciousness.

After Stangel shot Tammy Nguyen, Nada­moto said, he drove onto the H-1 and shot three other motorists near the Houghtailing Street exit, injuring two of them, including Amie Lou Asun­cion. He said Asun­cion pulled over after she was hit.

When she saw the gunman also pull over in front of her, Nada­moto said, Asun­cion ran across the freeway, jumped over the median and hid in bushes on the other side.

Meanwhile, two police officers were at a traffic stop near the Kao­nohi overpass in Aiea when Stangel drove up and rolled down his window, Nada­moto said.

They thought he was going to ask for assistance, but he shot at them instead, missing, he said.

Stangel’s lawyer, John Schum, told the jurors in his opening statement that Stangel doesn’t dispute that he killed Nguyen and shot at the two police officers, Pag­di­lao, Asun­cion and two other motorists. But he said the state has to prove that Stangel intentionally or knowingly did all that to kill or attempt to kill. He said none of Stangel’s actions are connected to any intended or foreseen result.

In pretrial hearings, Circuit Judge Glenn Kim told Schum that Stangel cannot use insanity as a defense if his drug abuse is the cause. He also prohibited Schum from calling as a witness the clinical psychologist Stangel’s previous lawyer had hired to examine Stangel.

Neither Schum nor Nada­moto offered the jurors any explanation for Stangel’s actions.
