Leemar Dacanay was heading out early July 6 last year, as he did every morning, to catch the bus to Wahiawa General Hospital to help care for his quadriplegic mother.
As he was crossing Kalihi Street near the Eluwene Street intersection, a pickup truck hit him.
An ambulance took him to the Queen’s Medical Center in critical condition. Dacanay, 30, died the following day.
Police said Dacanay was in a crosswalk and that the driver of the pickup, Wayne Kaya, was speeding.
A state judge sentenced Kaya Monday to one year of probation for misdemeanor negligent homicide. Circuit Judge Michael Wilson also ordered Kaya, 56, to spend a weekend in jail, prohibited him from driving for a year and ordered him to pay $11,459 restitution to Dacanay’s family and $567 to the state Department of Human Services.
Kaya asked Wilson not to send him to prison and apologized to Dacanay’s family.
"I didn’t mean for this to happen. I was driving to work and didn’t see him. I’m sorry that I took away his ability to live a full life." Kaya said.
Kaya’s lawyer said there is no evidence that Dacanay was in a crosswalk and that Kaya was traveling no more than 2 mph over the 25 mph speed limit.
Dacanay’s mother, Myrna, said she relied on her only son to care for her.
"He was my best friend. He was my life," she said in court Monday from her wheelchair.
Family members said Dacanay would spend all day with his mother at the hospital.
Since Dacanay’s death, his mother said her husband stopped working to care for her. She has been paralyzed from the neck down since 1992.
She told Kaya she forgives him but cannot forget what he did.
Kaya’s sister said since her father died in November, her brother has been helping care for their mother.
