A judge in a state animal cruelty trial ordered a defense witness taken into custody Wednesday for allegedly making a threat in the courtroom.
Circuit Judge Edward Kubo Jr. charged Wes Schlitzkus with contempt of court and had state sheriff deputies take him into custody. He also set a $5,000 cash-only bail.
Kubo scheduled a hearing for this morning to determine whether Schlitzkus is guilty.
Schlitzkus is a witness for David “Lanny” Moore who, along with his mother June Moore, is on trial for 24 counts of misdemeanor animal cruelty. The charges stem from the October 2016 seizure of more than 300 dogs from the Moores’ Friends For Life no-kill animal shelter in Makaha.
According to Kubo’s order charging contempt, Schlitzkus was leaving the courtroom for a recess after testifying when he uttered, “You better not come to Waianae.” It was not known who he was addressing. The people closest to him were Deputy Prosecutor Janice Futa and David Moore’s lawyer Harrison Kiehm.
Schlitzkus denied making the threat but the order said two individuals heard the threat.
Kubo had a prospective juror jailed on a $10,000 cash-only bail in February for alleged disruptive behavior during jury selection. He released the man without charges the following day after the man apologized.
