It was a shot to the heart from a device used by fishermen and alligator hunters that killed a man in Hauula last week, Deputy Prosecutor Duane Kokesch told a state judge Wednesday.
An Oahu grand jury returned an indictment charging Vincent R. Burdett Jr. with murder, using a firearm to commit the killing and other crimes. Circuit Judge Colette Garibaldi confirmed Burdett’s bail at $1 million.
Burdett, 54, has a 2004 felony firearm possession conviction that prohibits him from owning or possessing firearms and ammunition.
“In this case he did possess a bang stick, which is an item that can be used to fire ammunition. And he fired that ammunition at an individual, Justin Ako, at close distance penetrating his heart, killing him,” Kokesch told Garibaldi.
Bang sticks fire ammunition on contact. Honolulu police do not require bang stick owners to register the devices as firearms.
Police said Burdett killed Ako, 35, on Nov. 14 over a parking dispute. A witness told police Burdett yelled about a vehicle blocking his Anoilei Place home and Ako moved the vehicle. Burdett needed to drop off a grandchild he had been baby-sitting.
The witness said Burdett began arguing with Ako when the victim went to check if the vehicle he had moved earlier was no longer blocking Burdett’s way. The witness said he was about 30 feet away from Burdett and Ako when he saw a small flash and heard a pop.
Ako then walked toward him, the witness said, and told him he had been shot.
