Haleiwa Beach House fined for seating capacity violation
The North Shore’s Haleiwa Beach House restaurant received a $5,000 fine for relocating five chairs from its bar area to the dining area, violating an agreement not to increase the seating capacity approved in 2012.
The restaurant, formerly known as Jameson’s by the Sea, is owned by longtime Hawaii developer D.G. “Andy” Anderson, who was recently cited by the state Department of Health for expanding the restaurant’s seating capacity to 388 from 114 without enlarging its wastewater system.
State officials ordered Haleiwa Beach House to close after confirming that sewage was spilling from its wastewater system into a neighboring property near a fishpond frequently visited by children. The eatery reopened on June 7 after its owner agreed to serve fewer patrons to meet state requirements for wastewater system capacity. But during a DOH inspection on June 14, officials discovered the extra seating arrangement.
“The department will continue to conduct on site follow-up inspections at the restaurant to ensure it complies with the order and maintains public health standards,” Stuart Yamada, chief of DOH’s environmental management division, said today. “Any further violations will result in immediate closure of the facility and penalty fines.”
Anderson, a former state lawmaker who tried three times to become Hawaii’s governor, opened the restaurant in March as Haleiwa Beach House despite warnings from the city not to because renovation work was done without building permits.
DOH said another violation will result in a $25,000 fine.

State officials should fine the homeless $5,000 for defecating on the sidewalk, bushes, wherever.
Agree. Old man Lespark should collect the fines from the homeless.
Same old same old if there are no serious consequences .
Wait, this made headline news? 5 seats were moved to a place they weren’t allowed? LOLLLLL
old slyboots Anderson at it again
Andy is still at it, trying to make another buck. Reflects on his poorer early days. It was Frank Fasi who once said about Anderson character – Whats in it for me?.
He is pushing the envelope here. But, I like it. The City is just working him. This is really small potatoes. Just a posturing thing on both sides!
You his friend? Small kind cheating all the time come big you know. Shows his character. Next time I’m in the area I’m going to count the chairs better not have more then 114.
He’s dumping untreated sewage into a local fish pond, and you LIKE it? Are you a Trump supporter too?
These people just will not give up trying to beat the system. Anything to make a buck. They continued to cheat even after given a chance to reopen. The little fine levied
will not deter them from trying too sham the system. No wonder why the community was against Andy Anderson building a hotel in Haleiwa. It looks like this guy cannot
be trusted. There should be frequent inspections of the entire restaurant on a regular basis. For me I choose not to spend my money at this shady place.
Convenient afterthought – AFTER the backlash for not doing so.
Dumb fine. They are just picking on Anderson.
What a dweeb!
No penalty for opening restaurant renovated with no building permit?
Shut it down – that’s the only way DG will listen. He has a long history of disregarding laws. He’s is just making fools of the City and State.
I get it. Just go do whatever you want, then see if anything sticks. Makes perfect sense.
We can almost not fart here unless we get permission from the Mililani Town Association and this guy gets away with everything. If he tries anything in Mililani, he’s in big trouble.
Maybe they should appoint Anderson to the HART board with Felix.
Better yet…..make him Mayor or Govenor?…..as a Republican, nothing would get done.
If a person with a building permit closes his walls without an inspection, the inspectors can make you take off all the drywall so he can inspect inside the wall that everything was done right. If you don’t pass the inspection, you cannot close your walls until everything passes. So how come this idiot can break the laws & get away with it? He should have to tear down all his walls to have it inspected after he gets his permits.
