Prosecutors are expected to charge a retired Honolulu police major with negligent homicide in the death of a 49-year-old federal court employee who was killed while jogging in Mililani in February.

Charles T. Duncan, 73, of Mililani, was rearrested Friday morning on a criminal complaint in connection with the death of Mililani resident Shari Afuso on Feb. 5.

The prosecutor’s office said formal second-degree negligent homicide charges are expected.

He has been free while the accident was under investigation.

Duncan, who served 32 years in the Honolulu Police Department and was a watch commander for the department before he retired, has declined to comment on the case.

Police in February said Afuso was jogging in a marked crosswalk around 7 p.m. when she was hit by a 2012 Chevrolet pickup truck turning left onto Kuahelani Avenue from the southbound lanes of Meheula Parkway.

Paramedics took Afuso in critical condition to the Queen’s Medical Center, where she died.

The Honolulu medical examiner said the cause of her death was cranial cerebral injuries due to blunt force trauma.

Afuso, mother of two teenage children, was the courtroom manager for U.S. District Judge Kevin Chang.

She jogged regularly and was only a couple of blocks from her home when she was struck by the pickup truck.

She and her husband, Mark, had celebrated their 20th wedding anniversary a few days before the accident.
