Sex offender gets 5 years for non-compliance
WAILUKU >> A man who failed to comply with the law for registering sex offenders has been sentenced to prison.
The Maui News reports that 40-year-old Rodney Herbert was sentenced earlier this month to five years in prison after failing to update information about where he was living. He did not return at least seven address verification forms. He also failed to show up for a court appearance.
Herbert was required to register as a sex offender because of a 1994 conviction in California for lewd and lascivious acts with a child under age 14. Because he was sentenced in October to a five-year prison term for second-degree theft, Herbert wasn’t eligible for probation. He has been imprisoned for 18 of his 40 years, and was homeless when arrested in April.
