The wife of a 61-year-old Waianae convicted sex offender turned her husband in to police after he was recorded on video fondling a 4-year-old boy, court records said.
Kenneth Kozeniewski was indicted by a grand jury Thursday on a charge of third-degree sexual assault. He remained at Oahu Community Correctional Center on Sunday in lieu of $100,000 bail.
The incident allegedly occurred at about 4 p.m. May 31. Court records did not say where the incident occurred.
According to a police affidavit, a woman told police she was sitting across a table from Kozeniewski when he placed a 4-year-old boy on his lap.
The woman said she was concerned because she knew Kozeniewski was a registered sex offender, and placed her cellphone under the table to record Kozeniewski in case he tried to sexually touch the boy.
When the woman reviewed the video, she saw Kozeniewski with his hand inside the boy’s shorts, appearing to fondle the boy’s genitals.
Police met the woman at a house down the street from Kozeniewski’s home and took a statement.
When questioned, the boy said Kozeniewski placed his hand into his shorts and touched "his private."
An officer watched the video and confirmed the woman’s account.
About two hours after the incident, Kozeniewski and his wife, Homelani, showed up at the Kapolei police station.
Kozeniewski’s wife told the investigating officer that she saw a video of her husband touching the boy’s genitals and brought her husband to the station. Kozeniewski was arrested without incident.
In 2003, Kozeniewski was sentenced to five years’ probation for two counts of third-degree sexual assault.
A media report of his arrest in that case said he was accused of assaulting four victims between the ages of 5 and 23. Kozeniewski allegedly tried to assault a 5-year-old girl, and after further investigation, three others said they had been assaulted.
