A Village Park man who wound up getting shot along a freeway offramp in Kunia after fleeing from a deputy sheriff Saturday morning is now back in the custody of sheriffs.

James J.K. Fontanilla III, 39, was arrested and charged with unauthorized control of a motor vehicle, first-degree terroristic threatening, second-degree theft and third-degree theft. Bail was set at $200,000.

Fontanilla is believed to have been the man driving a 1990s model Honda Accord that a deputy sheriff attempted to stop for a routine traffic violation in the airport industrial area Saturday morning. 

The chase wound up about 15 to 20 minutes, and 12 miles, away at the Kunia offramp at H-1 westbound. 

There was a struggle and somehow the driver was shot, state deputy sheriff Charles Lacaden said Saturday. It was not clear if the deputy shot the suspect, or if the gun went off accidentally, he said.

Details remained muddy today.

Fontanilla was taken to Queen’s Medical Center in serious but stable condition. He was arrested by the Honolulu police officers Monday but was transferred to the custody of the sheriff’s office.

The deputy sheriff, who is in his late 40s and has more than 10 years in the Sheriff’s Office, was taken from the scene to the hospital with minor injuries, Lacaden said.

A passenger in the stolen vehicle was not injured and was arrested.

Mickel J. Juliano, 42, of Waipahu, was charged with unauthorized entry into a motor vehicle and was released on $2,000 bail.
