FBI publishes notes on Clinton’s use of private email

WASHINGTON >> Then-Secretary of State Hillary Clinton relied on the judgments of her staff and others not to illegally send emails containing classified information to her private email server, and told FBI investigators she was unclear about a classification marking on official government documents.

The revelation came Friday as the FBI, in a rare step, published scores of pages summarizing interviews with Clinton and her top aides from the FBI’s recently closed criminal investigation into her use of a private email server in the basement her Chappaqua, New York, home.

Clinton told the FBI she never sought or asked permission to use a private server or email address during her tenure as the nation’s top diplomat, which violated federal records keeping policies.

Clinton has repeatedly said her use of private email was allowed. But over 3 ½ hours in an interview in July, she told FBI investigators she “did not explicitly request permission to use a private server or email address,” the FBI wrote. They said no one at the State Department raised concerns during her tenure, and that Clinton said everyone with whom she exchanged emails knew she was using a private email address.

The documents also include technical details about how the private server was set up. It is the first disclosure of details provided by Bryan Pagliano, the technology staffer who set up and maintained Clinton’s IT infrastructure. Pagliano secured an immunity agreement from the Justice Department after previously refusing to testify before Congress, invoking his constitutional right against self-incrimination.

Large portions of the FBI documents were censored. The FBI cited exemptions protecting national security and investigative techniques. Previous government reviews of the 55,000 pages of emails Clinton returned to the State Department found that about 110 contained classified information.

Friday’s release of documents involving the Democratic presidential nominee was a highly unusual step, but one that reflects extraordinary public interest in the investigation into Clinton’s server. Republicans have used the email issue, as well as the family’s charitable foundation, to argue that Clinton is not trustworthy and should not be elected.

The FBI’s investigation focused on whether Clinton sent or received classified information using the private server, which was not authorized for such messages. Clinton told the FBI she relied on others with knowledge about handling classified files not to send her emails inappropriately.

“She had no reason to doubt the judgment of the people working for her on the ‘front lines,’” the FBI wrote about one email.

Clinton was also asked about a 2011 email that caught the attention of investigators in which she directed one of her advisers, Jake Sullivan, to transmit a set of talking points and turn it “into nonpaper w/no identifying heading and send nonsecure.”

Clinton told the FBI that she believed she was asking Sullivan “to remove the State Department letterhead and provide unclassified talking points” and that she had no intention of removing classification markings.

In her interview, Clinton said she was unfamiliar the meaning of the letter “c” next to a paragraph and speculated that it might be “referencing paragraphs marked in alphabetical order.” That particular email had been marked as “confidential,” the lowest level of classification. Clinton said she did not pay attention to the classified level “and took all classified information seriously,” according to the FBI notes.

After a yearlong investigation, the FBI recommended against prosecution in July, and the Justice Department then closed the case.

FBI Director James Comey said that while Clinton and her aides had been “extremely careless,” there was no evidence they intentionally mishandled classified information.

Republican House Speaker Paul Ryan issued a statement saying the documents show Clinton’s “reckless and downright dangerous handling of classified information.”

“They also cast further doubt on the Justice Department’s decision to avoid prosecuting what is a clear violation of the law,” Ryan said. “This is exactly why I have called for her to be denied access to classified information.”

The FBI director said the government found no direct evidence that Clinton’s private server was hacked but said foreign government hackers were so sophisticated — and the server would be such a high-value target — that it was unlikely they would leave evidence of a break-in. Clinton told the FBI she was unaware of specific details about the security, software or hardware used on her server and occasionally received odd-looking emails. But she told agents there were never so many suspicious emails to cause concerns.

She also said she had no conversations about using a private email server to avoid her obligations under the Federal Records Act or the Freedom of Information Act.

Clinton told investigators that she directed her aides in early 2009 to create a private email account and that it was “a matter of convenience” for it to be moved onto a system maintained by her husband’s staff.

She told investigators that “everyone at State knew she had a private email address because it was displayed to anyone with whom she exchanged emails,” according to a summary of the July 2 interview released Friday.

Clinton said that when top staff received an email, the recipient would evaluate whether the information should be forwarded to her, but that no one at the State Department raised concerns about her using a private email account or server and said no one on her staff “ever expressed a concern regarding the sensitivity of the content of these emails.”

          If anyone had any lingering doubts that Secretary of State Clinton proactively beavered away to anticipate and avoid FOIA demands that would threaten to reveal her intended commingling of government matters and her lucrative family “foundation” for personal gain, the FBI document dump on the Friday of Labor Day weekend should decisively put those doubts to rest.

          No wonder she had her clandestine ‘home brew’ server installed in her basement along with using what the FBI now reveals as “13 other mobile devices and five iPads that had potentially processed classified material.”

          The once honorable Democrat Party has fallen on hard times indeed if this sorry specimen is the best they can dredge up to serve as their standard bearer.

If a military personnel, CIA or an FBI agent did what she did, that agent would beeen in jail by now. She is right to assert that there are two standard used to investigate her, those used for ordinary agents and one used to investigate her acts, and she got away with a crime.

        Learn the facts before you comment. Rice and Powell may have received a hand full of official emails using private email accounts when they did not have access to their government email servers, but almost 100% of their government emails were sent or received over secured government email servers. Hillary, on the other hand, conducted 100% of her government business on a private, unsecured server, and by doing so she made sensitive and classified information highly susceptible to hacking and exposure. She was careless, negligent, reckless and stupid to have done so and no one with such little regard for national security be allowed in the White House. I also believe what she did was illegal and that she should be prosecuted and thrown in jail. Yes, I know, FBI Director Comey said she did not intend to violate laws, but intent is not an element of the law regarding mishandling of classified materials. It is gross negligent, a standard Hillary easily met.

The State Department said in February that some aides to Rice received classified information on email, but those were aides, not Rice, and the emails were received by, not sent from, private accounts.”

        First, she will be the POTUS, not president of the Clinton Foundation. Second, there is no email server in the world that anyone, including the FBI, could definitively say it has not been hacked. She has apologized, has stated it will never happen again.

        Most importantly, Clinton has stressed that she will make transparency and accountability a priority if elected as POTUS.

        So, if you take away the foundation issue and email issue, what does Trump have to offer or stand on? We would have a lot more respect for Trump if he were to at least take a position on those issues that really matter to the people. And Clinton should not be wasting time on the foundation and email issues, she should also be talking about the issues that really matter to the people.

        Simply because, we would not want to elect our next POTUS on those two issues which we have had to stomach ad nauseam. If we are going to elect someone, let’s do it with some sanity.

    81 email chains transmitted and stored on the female felon’s private unclassified server contained 8 top secret, 37 secret and 36 confidential email chains that were classified at the time they were sent. the state department identified an additional 2,000 emails currently classified confidential and one currently classified secret that were transmitted and stored on the female felon’s personal server.

    four years of intentionally mishandling classified information was whitewashed by the fbi who refused to forward the investigation to the justice department for evaluation for prosecution.

          The definition of “Racist” from Dictionary.com – “a person who believes in racism, the doctrine that one’s own racial group is superior or that a particular racial group is inferior to the others.”

          Focus on that second part of the definition – “a particular racial group is inferior to the others”. Trump said that Judge Curiel is unfit to preside over his case because of his race. Trump makes the blanket statement in which he literally calls immigrants of a certain race “rapists” with no evidence of any kind to qualify his statement. He makes judgements of people solely based on their ethnicity and that doesn’t count as “racist” for you? Geeze, I hate to see what your definition of racism is! Does he have to put them in death camps before he makes your racism meter beep? Calling an entire group of people “rapists” based on their race is one of the most racist things I’ve ever heard a public figure say in the 21st century. How can you say, with a straight face, that that isn’t racist? Please explain to me, if possible, how those two things (and they aren’t even the only racist things Trump has been accused of) are not racist.

    Other people have been prosecuted for much less than this lady. I have little doubt that the decision not to prosecute was a political one not based on the crimes she committed. The Director of the FBI so much as said so. He never said she was innocent. It clearly shows the fact that politicians and government workers have been granted powers greater than any of us peons have. This is not a political statement as I think both parties are corrupt. It just angers me that our government is so corrupt.

      Read the article and see that they found no evidence of a big crime. She wasn’t doing espionage with the Russians. She wasn’t using the Clinton Foundation to get rich.

      AhiPoke: You just summarized this thing into a neat and simple statement: “It clearly shows the fact that politicians and government workers have been granted powers greater than any of us peons have”. Our system of government was set up to avoid this kind of corruption with separation of powers. The bill of rights was intended to avoid a tyrannical government. Unfortunately this separation has been eroded over time especially in the last 8 years with Barry ignoring the constitution and republicans allowing him to get away with it.       She answered “I don’t remember” to FBI questions 38 times…she has serious HEALTH ISSUES from the fall she had. Or…hiLIARy’s Foreign Policy Adviser Jake Sullivan back in 2011 researched Parkinson & Alzheimer drugs for her.

      Wrong, she deleted emails after 2 weeks after learning that there was a request for her emails. That’s obstruction and there’s no way of spinning it. I can’t believe the people here denying Hillary has been corrupt. Comey totally contradicts her public statements. What is valid for you to say is that it is not illegal to lie to the public. Then, the only recourse is to vote someone out of office.

    the female felon’s mental health is serious enough that her doctor limited her to working a few hours a day and she could not remember vast numbers of briefings, security trainings and nda requirements.

    combined, the female felon’s overall health is a liability for anyone seeking to hold the office of president of the united states. with fainting spells, dizziness, falls, spasms, blood clot, memory failures, confusion, concussion effects and continuing fatigue any other candidate for president would have been vetted severely by the media in any open press conference.

    only gruber voters believe her refusal to appear before open uncontrolled press conferences is to avoid questions about her criminal money laundering foundation and intentional disregard in handling classified information.

Now she’s setting the table to throw aides – she already slimed General Powell – under the bus to save her sorry skin. She’s exhibiting all the classic signs of a psychopath. Inability to feel remorse or empathy and highly egotistical. I took a semester of Abnormal Psych in community college so I know what I’m talking about. We again have to ask ourselves if we want Hillary to have access to nuclear launch codes should she become president. The clear thinking logical person emphatically says “no way Jose”.

    Very weak defense of Hillary. No mention in the article that Hillary wiped her illegal server clean two weeks AFTER she was asked to produce her emails. That’s obstruction of justice, well, at least to anyone other than Hillary. Consider what Nixon did versus what we’ve learned to date about Hillary’s actions. Nixon’s actions were child play compared to what we’re currently dealing with.

    1. She cited her 2012 concussion as the reason that she cannot remember details of briefings during her “transition out of office.”

    2. She said she never even thought whether emails she exchanged on a future U.S. drone attack should be classified

    3. She said she thought the “C” before a paragraph indicated alphabetical order. The C actually stands for “confidential.”

    4. She said no one ever raised concerns to her about her use of a private email server.

    5. She said she could not recall any training on how to handle classified information.

    One lie after another. Deport Hillary!
