Homeowners sue developer for not building Ewa marina
Homeowners in Ewa Beach’s Hoakalei Resort and Ocean Pointe communities are suing developer Haseko Inc. over its decision not to construct the planned Ewa marina.
Lawyers for the homeowners filed a class-action lawsuit in state court Wednesday afternoon.
The homeowners claim Haseko’s decision in late-2011 to construct a land-locked lagoon instead of a marina that is connected to the ocean has negatively affected their property values.
In addition, the Hoakalei Resort homeowners say they have been paying community association fees for the maintenance and operation of the marina for years.
The previous developer won a hotly-contested approval from the state Land Use Commission in 1984 to construct the marina with 2,500 boat slips and 8.5 miles of connecting waterways.
